Often one hears the words “I never saw this one coming – the debtor was paying generally on time”. There have been a rash of media related bankruptcy filings and insolvencies over the past few years, including the recent chapter 11 filing by  KSL Media. When KSL filed their  chapter 11 case, numerous legal issues immediately arose under the Bankruptcy Code and under simple contract law.   Included among these issues were and are:

●          Can a media provider stop running ads after the bankruptcy filing
●          Does the media provider have a  claim against the advertiser(s) that placed the ad through KSL or is your claim limited to KSL
●          Does the media provider have an administrative claim against the Chapter 11 Debtor  for ads run post-petition

The terms of your arrangements with the advertisers and agency or buying service play a critical role in addressing these issues. This program will discuss  the current status of KSL and what led to its chapter 11 filing; the claims, rights and obligations of media providers and advertisers who must deal with this  bankruptcy filing and what you can and cannot do under your contracts, some of which hold the advertiser liable whether or not payment was made to KSL.
